Employment Law – Freedom of Expression
On February 12, 2025, the Court of Appeal ruled that the dismissal of Kristie Higgs from her role at Farmor's School in Gloucestershire was unlawfully discriminatory and disproportionate. Higgs, a Christian pastoral administrator, was terminated in 2019 after sharing Facebook posts critical of LGBTQ+ relationship lessons in primary schools. The court recognised her expressions as protected under the Equality Act, emphasising that while her posts were critical, they did not justify dismissal, especially given the absence of discriminatory behaviour in her professional conduct. This decision underscores the balance between freedom of expression and maintaining inclusive environments in educational settings.
