AI prompts are transforming the way legal documents are drafted. When crafted with technical precision, prompts can greatly enhance the utility and credibility of AI-generated content, especially when the AI relies exclusively on data contained in client matters, without incorporating outside sources.
A well-drafted AI prompt acts like clear instructions from a senior lawyer to a junior colleague on how to prepare a legal document. It defines the scope of the task, identifies the necessary information and its approved sources, specifies the required format and outlines any legal or procedural requirements. It also expressly forbids the use of external or unauthorised sources, including invented or fabricated content – commonly referred to in the context of AI as hallucination.
The outcome of using a well-constructed AI prompt in a matter that contains sufficient reliable data should be a competent first draft of a document, which the lawyer can then refine and perfect, either with or without further input from AI.
Where the matter lacks sufficient data to meet the prompt’s requirements for the document, the AI can assist by identifying the missing data the lawyer will need to obtain through instructions or other means.
